Property Rights
The elements of design work for projects remain the designer’s property whether or not the project or job is executed.
Approval of Final Artwork/ Photography
The Client must proofread and approve all final types before the production of work. Final proof will include artwork itself, size, shipping address and quantity. NO refunds or reprints are given after a final approved design is completed/printed. Client is provided a specified number of revisions to the design after agreement of initial completion. Any further changes are billed at specified hourly rate.
Rights
Other than for the promotional use of the designer/ producer, all services provided by the Designer/ producer shall be for the exclusive use of the clients said purposes ONLY. Designs/ music may not be used for other promotional items, websites, or printed material without permission. Upon payment of all fees and expenses, reproduction rights for all approved final designs/ music created by the designer/ producer for the project shall be outlined in the original estimate.
Ownership
All artwork, music, and visual presentation materials remain the property of the designer/ producer to show in printed or online portfolios for the length of the lifetime of the artist. Upon request, artwork/ music may/ may not be prevented from public viewing in these various portfolios. All preliminary concepts, music, and visual presentations produced by the designer remain the property of the designer and may not be used by the client without written permission of the designer.
Permission to use personal photography will be requested for each photo shoot. The exclusion of personal photos from the designers public portfolio will ALWAYS be granted up request, and upon request, all photography will remain confidential.
Liability of Designer
The designer shall take reasonable precautions to safeguard original or other materials provided by the client. The designer shall, however, not be liable for any damage to, or loss of any material provided by the client, including artwork, photographs, or manuscripts, other than or on account of willful neglect or gross negligence of the designer.
Payment of Fees
Fees are due and payable in the following manner:
50% deposit, 50% upon completion but before delivery/ shipment of artwork/ music for all work totaling over $50. All other work requires full payment in advance unless stated and written otherwise by the designer/ producer in the initial contract. On certain projects, such as those with a lengthy process payment plans/ schedules can be organized, and will be spelled out in original contract.
Refunds
Once a project has been designed in full according to the agreed upon project, no refunds are given after design has been approved. If print is determined poor by client to the designer’s discretion, your order will be reprinted at no cost. Refunds for shipping and printing are not given
Time
After deposit is given and project has been outlined, we will provide you with and estimated turnaround time. Turnaround times and estimates are subject but rare to change due to requests of the client/ circumstances of the designer/producer.
